Certified Process Servers Application

O. C. G. A. § 9-11-4.1(a) authorizes the Judicial Council of Georgia to promulgate rules and regulations regarding certified process servers in Georgia by requiring all those desiring to become certified process servers in Georgia to comply with O. C. G. A. § 9-11-4.1 “and any procedures and requirements set forth in any rules and regulations promulgated by the Judicial Council of Georgia regarding this code section. ”
The Sheriff of each county shall accept certification applications. The Sheriff retains the discretion to permit or deny a certified process server to operate within the county of jurisdiction.
Prior to service, a certified process server must file with the sheriff of the county, written notice, in such form as prescribed by the Georgia Sheriff’s Association (GSA), of the server’s intent to serve process in that county.
Such notice shall be effective for a period of one year; and a notice shall be filed before the certified process begins.
Requirements to be a certified process server in Georgia, an individual must:
- Be at least 18 years of age;
- Be a citizen of the United States or a repatriated or naturalized citizen of the united States as of the date employment commences as evidenced by a certified copy of applicant’s birth certificate.
- Not have:
- Been convicted of or entered a plea of nolo contendere to a felony or impersonating a peace officer or other public employee under O. C. G. A 16-10-23;
- An outstanding warrant for arrest; or
- A pending criminal charge in the following areas: felony, domestic violence, or misdemeanor involving moral turpitude.

- Two passport photos
- Certified copy of applicant’s birth certificate
- Proof of completion of a fingerprint based criminal background check
- Certificate of completion of the 12-hour pre-certification training Gappsprocess.com
- Certificate of successful completion of certification exam
- Copy of commercial surety bond or policy of commercial insurance ($25,000 or greater)
- $80 application fee (money order or cashier’s check only)
- Additional fee of $27.75 cash or money order/ cashier’s check, made payable to the Forsyth County Sheriff’s Office for fingerprint based criminal background check (this is a non-refundable service fee).
NO INCOMPLETE PACKAGES WILL BE ACCEPTED
- If rejected, Special Services Section will send a letter to the applicant detailing the reason via registered mail.
- Georgia Certified Process Server Identification Card Photograph Submission Instruction (Form 2.)This form provides the applicant with the directions required to submit the photograph to the Georgia Sheriff’s Association.
- Once Special Services Section has verified the approval of the application, a copy will be submitted to the Georgia Sheriffs’ Association (GSA).
- GSA will mail the applicant’s identification card to the Special Services Section.
- Special Services Section will forward the original application, background check returns, identification card, F.C.S.O. Certified Process Server Oath (Form 3) and F.C.S.O. Certified Process Server Authorization Request to Serve Process (Form 4) to the sheriff or sheriff’s designee.
The sheriff’s office shall notify the applicant to report to the Sheriff’s Office, 475 Tribble Gap Road, Suite 105, Cumming, GA 30040, to claim the identification card and for the administration of the process server oath. The sheriff or the sheriff’s designee will administer the Certified Process Server Oath.
Following the affirmation of the oath, the Authorization Request to Serve Process (Form 4) must be completed by the certified process server and the sheriff or sheriff’s designee. This document validates or denies the processor’s authority to serve process in Forsyth County.
In the event of a lost or stolen identification badge, the process server must notify the certifying Sheriff at the Special Services Section within three days of discovery of loss. Upon completing the Lost/Stolen Credential Replacement Form, Download Form and payment of $30 to the Forsyth County Sheriff’s Office, the certifying Sheriff shall request and issue a replacement Identification Card.
